Mel Gibson's ex won't be charged with extortion

Oksana Grigorieva will not be charged for allegedly trying to extort money from ex Mel Gibson.

While Mel Gibson will soon face the (legal) music, Oksana Grigorieva won't have to.

According to RadarOnline.com, the Los Angeles District Attorney's Office will not charge Grigorieva with extortion after a months-long investigation.

Gibson, 55, had claimed his ex-girlfriend reneged on a $15 million settlement plan and secretly recorded their conversations in order to blackmail the actor into paying her more.

But on Friday, "the DA's office will announce that the extortion case was rejected," a source told Radar.

"There wasn't enough evidence to prove that a crime occurred," the source explained.

Gibson, however, is expected to plead no contest to misdemeanor battery, stemming from a Jan. 6, 2010 domestic violence incident with Grigorieva.

Gibson admitted in a court declaration last year that he struck the Russian-born musician because she was shaking their now-15-month-old daughter, Lucia.

On Wednesday, the "Braveheart" star's attorney said he chose to accept a plea deal to avoid subjecting his family to a trial.

"Mel's priority throughout all of this has been that the best interests of his young daughter Lucia and the rest of his children be put first in any decisions made," lawyer Blair Berk said in a statement. "It is with only that in mind that he asked me to approach the district attorney with a proposal that would bring all of this to an immediate end."

Radar's source said Grigorieva "could make a victim's impact statement" at Gibson's hearing on Friday, "but it doesn't seem likely that she will appear."

Sources told the Daily News that it is likely Gibson will be sentenced to informal probation and community service as well as counseling.
